Using the website
Content on this site is provided for general information. You agree not to misuse the site, attempt to gain unauthorised access, or infringe our intellectual property.
Engagements
Any project we deliver is governed by a separate written proposal or statement of work, which takes precedence over these site terms. Projects are delivered remotely from the United Kingdom regardless of client location.
International clients
For clients based in the United States, Hong Kong, Singapore, Australia or New Zealand, our services are supplied on a business-to-business basis from the United Kingdom. You are responsible for any local taxes, duties, import charges or regulatory requirements that apply in your jurisdiction, and for ensuring that our services are lawful for your intended use locally. Where local consumer-protection or business-conduct laws apply and cannot be excluded (for example the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, Singapore's Consumer Protection (Fair Trading) Act, or Hong Kong's Sale of Goods Ordinance and Trade Descriptions Ordinance), those rights are preserved.
Payments
All work is quoted as a fixed price agreed before work starts. Quotes and invoices are issued and payable in the client's local currency (GBP, USD, HKD, SGD, AUD or NZD), at the conversion rate stated in the quote; the quoted local-currency amount is the amount payable. Indicative prices shown on this site (for example websites from £299) are reference figures and appear as the local-currency equivalent in your quote. Invoices are payable within the terms stated on the invoice; bank fees and international transfer charges are the client's responsibility. Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.
Liability
Nothing in these terms excludes liability that cannot be excluded under UK law or any applicable non-excludable local law in your jurisdiction. Subject to that, our total liability arising from a project is capped at the fees paid to EKKO for that project in the preceding 12 months.
Governing law
These terms are governed by the laws of England and Wales, with exclusive jurisdiction in the English courts. By engaging EKKO from the United States, Hong Kong, Singapore, Australia or New Zealand, you agree to this choice of law and forum, save for any non-excludable rights under your local law.
